
1.1 To qualify for the “Early order Gift” clients must process and complete their order before the Friday 14th November 2009, and the net value of this order must exceed €700, (excluding VAT & any delivery charges). The Client placing the order will receive a Wine Casket Gift as shown in the Brochure on page 4.
1.2 The Wine Casket Gift will be delivered Free of charge (within Ireland) to the client order address only. (Delivery to any other address will incur a delivery charge based on our single item order, dispatch rates for that region).
1.3 The “Early order Gift” offer is limited to one Wine Casket per client/order.
1.4 The definition of an “order” that qualifies for an “Early Order Gift” is one that meets all the criteria above and is placed by one single client. Multiple orders (or orders split onto several orders) from one client or the same order address does not qualify for a “Early order Gift”. The Company reserves the right to amend or modify the conditions regarding the “Early order Gift” offer at anytime without further notice.
2.1 For UK & Worldwide deliveries please place your order as soon as possible. The Latest Order date for the:
2.1.1 Republic of Ireland & NI: Monday 15th December 2009.
2.1.2 UK: Monday 8th December 2009.
2.1.3 EU: Friday 21st November 2009 (refer to delivery table for specific countries).
2.1.4 USA: Friday 14th November 2009.
2.1.5 The latest order date for all other International destinations is: Friday 14th November 2009.
2.2 The Company cannot accept responsibility for the late delivery of Hampers/Gifts where orders are placed after the Last order dates noted above.
2.3 The Company cannot accept responsibility for the non-delivery or late delivery of Hampers/Gifts, if the recipient address and telephone details are insufficient or incorrect.
3.1 The Company manages a seasonal competition via the subscribed online Newsletter.
3.2 To enter you must be in receipt of the companies seasonal newsletter.
3.3 The competition prizes are detailed in the Newsletter and on the Website promotions pages, which are also limited to recipients of the Seasonal Newsletter.
3.4 You must answer correctly a question contained in the Newsletter to be entered for the draw.
3.5 The draw is administered by the companies management team.
3.6 The companies decision regarding prize awards are final.
4.1 The minimum order for customised hampers is Twenty (20) and such orders must be received by the Friday 21st November 2009.
4.2 Customised Export Hampers & Gift Boxes: Please contact The Company Customer Service team for assistance with customising Hampers for export purposes. Please note however that all the limitations noted further in these terms & conditions apply, regarding exporting of Hampers and the foreign Customs & Excise services in each particular country. Even if the Hamper has been modified in good faith to try and clear foreign customs services procedures.
5.1 The Company is one of the few large Hamper & Gift companies that can accept personalised greeting cards or compliment slips to accompany the selected Hamper or Gift Box.
5.2 Please refer to Greeting cards section on the web site www.hampersandco.com for specific details & requirements regarding personalised Greeting Cards or compliment slips.
5.3 The Company cannot accept responsibility for the late/delayed delivery of Hampers/Gift Boxes, where Personalised greeting cards or Compliment slips are received later than five (5) working days prior to the clients required delivery date.
6.1 All the prices shown in the Brochure are valid from the time of going to press until 31st August 2009, while stocks last.
6.2 Prices quoted in the brochure/Website are exclusive of VAT.
6.3 Prices quoted in the brochure/Website are also exclusive of delivery charges. Please refer to the “Ordering Information” section of the order form for details of single item delivery charges within Ireland & Northern Ireland. Separate quotations will apply for all other delivery types and locations.
6.4 During the 2009/2010 season The Company may run additional discount promotions, or offer new Hampers & Gift products or services with the pricing being detailed at that time.
6.5 Irish VAT is not applicable on orders being sent to Non-EU countries where the Invoicing address is also a Non-EU country. However if the Invoicing address is within the EU, VAT is applicable and will be charged accordingly on the invoice.
7.1 A deposit of 50% of the gross order value must be paid at placement of the order by new accounts the balance of payment is required in full upon receipt of goods.
7.2 The Company can accept the following payment methods: Visa, Mastercard, Laser, Cheque or Bankers drafts, which are to be made payable to “Hampers & Co”.
7.3 The company may at it’s own discretion offer a 30 day invoiced payment period to clients, agreed at the time of placing the order with the company. Which will be invoiced at the point of dispatch of the goods. Invoiced orders require full payment within strictly 30 days from the date of invoice.
7.4 Invoices and deposits are payable on the dates and periods identified in the respective invoices and we reserve the right to charge interest at the rate of 1 percent per month (or at the rate for the time being applicable under the Late Payment of Commercial Debts (Interest) Act 1998, whichever is the higher) on all amounts outstanding after the due date.
7.5 The lack of the proof of delivery or tracking records at the time of invoicing/payment is not an accepted reason for withholding payments. The company will suitably compensate clients for any items that are subsequently confirmed as being undelivered.
8.1 All goods remain the property of The Company until all goods, services and all outstanding debts to the company have been paid in full. .
9.1 Risk in respect of the goods transfers to the purchaser upon execution of the delivery docket.
10.1 During the December peak period deliveries for specific days or times cannot be guaranteed.
11.1 Delivery to an individual address is charged at €14.00 (excluding VAT) per Hamper or Gift box within the Republic of Ireland. Please allow a minimum of five (5) working days for deliveries within the Republic of Ireland from point of placing order. We will endeavour to expedite items on the same day, but due to seasonal peaks same day dispatch may not be possible.
12.1 Delivery of Multiple Hampers or Gift Boxes to one nominated location is FREE of charge for an order value over €1500 (net order value, excluding VAT).
12.2 Delivery of multiple Hampers or Gift Boxes to one address with an order value of less than €1500 (net order value, excluding VAT). We can provide reduced shipping costs. Prices vary depending upon destination, quantities, weights, and delivery times, etc. so please enquire with the Customer Service team for a quotation on our very reasonable shipping rates, contact 01-851-1098.
12.3 Deliveries to a single address for several items will be dispatched at the same time. However due to circumstances outside of our control, in the December period these items may unfortunately arrive at different times.
13.1 Delivery Outside of Ireland will require a separate quote for all such orders. The Customer Service team can provide this information, contact 01-851-1098.
13.2 For items being exported, the delivery charge covers the packaging and delivery only. Customs duties may be payable by an overseas recipient and we regret we are unable to advise of these amounts. We can in some cases direct you to specific courier companies and their Web sites which may contain further details on this subject.
13.3 The Company cannot guarantee delivery dates for Export orders.
14.1 Irish Provincial Hampers cannot be held responsible should local customs authorities wish to confiscate any particular item, delay shipment or charge import duty on any Hampers or Gifts boxes.
15.1 Returns: Any additional charges incurred in the completion of a delivery or the returning of goods, due to incomplete recipient information from the client, will be liable for all related charges and costs. This applies to national and international deliveries.
15. 2 Re-Delivery: Any additional charges/costs incurred in the completion of a delivery (Re-sending) of goods, due to incomplete original recipient information from the client, or the recipients being unable to collect the item in the time frame specified period from will be liable for all related charges and costs. This applies to national and international deliveries.
16.1 If you do not receive your Hamper/Gift Box in perfect condition please contact The Company within 24 Hours if within Ireland or 72 hours if an International delivery address.
16.2 Cancellations are accepted prior to the dispatch of goods from our warehouse.
16.3 Cancellations after Dispatch: requires the items be returned complete before a full refund is issued.
16.4 Cancellation of Customised Hampers or Gifts: will incur a restocking charge. A charge of 20% of the (ex. vat) unit price of the selected items will be applied to a clients account.
16.5 Non Delivery: A full refund is provided for complete non-delivery or lost items. Items arriving late but arriving intact and fit for purpose will only be refunded, once the original item(s) are returned to our warehouse as a part of this process. Items arriving within 1 Business day after the requested delivery date within Ireland are not deemed to be late for the purposes of this clause. International addressed items arriving within 3 business days after the requested date are not deemed to be late for the purposes of this clause.
17.1 In the event of a non-arrival please contact The Company within 28 days of the expected delivery date and quote the order number and client details shown on the invoice paperwork.
18.1 The Company must be notified in writing, to the Customer Service Department, giving details as shown on the Delivery/Address label. A description of the damage is also to be provided.
18.2 Damaged individual items are replaced on a one for one basis.
18.3 Damaged Hamper: A Hamper or Gift item damaged in delivery to the point of being unfit for purpose must NOT be signed for, by the recipient. This will readily confirm damage in transit. Such an item will be replaced including all related delivery charges. We will require the original damaged item be returned as a part of this process.
19.1 Proof of delivery cannot be provided for all deliveries. However there are facilities for the selective tracking of items that have not reached their destination within a reasonable period of time, after the actual dispatch date. Tracking numbers can be provided by The Company and proof of delivery can be obtained by the person or company placing the order, via the internet.
19.2 The lack of the proof of delivery or tracking records at the time of invoicing is not an accepted reason for withholding payments. The company will suitably compensate clients for any items that are subsequently confirmed as being undelivered.
19.3 The Company, can provide further details on this particular courier service.
20.1 All items are subject to availability. If due to unforeseen circumstances it is necessary to substitute an item, the replacement item shall be of equal or greater value than that which it replaces.
20.2 The Company reserves the right to substitute items, without specific notice being provided, where such substitutions may unfortunately occur.
21.1 Photographs in the Brochure and on the Web site are accompanied by an itemised list describing the contents of each Hamper or Gift Box. Please note that for photographic purposes some props have been used and these are not included in the particular Hamper or Gift Box.
22.1 The Company reserves the copyright to all images and text contained within the Brochure and the Web site, with the exception of any quotations as noted here.
23.1 As with other large organisations, telephone calls to The Company may be recorded, for security and service monitoring purposes.
24.1 Items Featured in the Brochure as part of a Hamper or Gift set are not available as individual items, via the Brochure or via the Online ordering facility. Individual item types can only be ordered in the case or box quantities as they are bulk shipped to The Company from the source suppliers. Prices for such orders can be provided on an individual basis at the Companies discretion.
25.1 Please note that Hampers or Gift boxes containing chilled goods are labelled as such. Please open and refrigerate the chilled products as soon as possible after delivery (where possible), even if this is for an interim period prior to further transportation. (i.e. Whilst in your office or facility). Failing this please store the Hampers or Gift boxes in a cool dark or cold location.
26.1 Use of the Companies Brochure/Website and related ordering facilities constitutes acceptance of all the terms and conditions including agreement to follow and be bound by these terms and conditions. These terms and conditions may be amended at any time by the company and usage of the Brochure/Website and related ordering facilities subsequent to these amendments constitutes agreement to be bound by these amended terms and conditions.
27.1 “Hampers & Co” is the registered Business and trading name of Irish Provincial Hampers Ltd, a privately owned, limited company. Both of which are included in the references “The Company” in these Terms and Conditions of Sale.
28.1 These terms & conditions and their interpretation shall be in accordance with the laws of Ireland and the parties submit to the exclusive jurisdiction of the Irish courts in resolution of any issues.
29.1 The Company takes all reasonable care in the preparation and packaging of fragile and delicate items contained in the Hampers & Gift boxes. However, in the unfortunate event, that such delicate items are damaged in transit, The Company shall be responsible for the replacement costs of the item only. The Company reserves the right to furnish such replacement or equivalent items as they are readily available, and with due consideration where possible, to the clients particular delivery needs.
29.2 The Company shall not in anyway be responsible for any personal injury, consequential loss or damages to property howsoever caused.
30.1 Unless indicated otherwise your use of the Brochure/Website and related ordering facilities constitutes your agreement with the Company to reply to you by electronic mail or other communication methods for such purposes as the company may consider appropriate.
30.2 With a view to understanding our customers better, may retain the information you provide to us about yourself, including details of any purchases you may have made, to offer products and services that are likely to interest you.
30.3 We may carry out market research by letter, telephone, email or other reasonable means of communication, or occasionally pass your details to othe associated companies, business associates or other carefully selected organisations.
30.4 If you would prefer us not to hold your information as set out above, please write to The Company at the address details below.
31.1 The Company, reserves the right to refuse to supply any individual or organisation/company and also reserves the right to deny access to the Brochure/Website facility.
32.1 1 The Company, are not liable for increased shipping costs, loses or delays of items due to Acts of God.
33.1 The Company is not liable for increased shipping costs, loses or delays items due to third party Union actions where The Company are not directly involved in the related negotiations for the dispute.
